Our Fees

Cooper Grace charges clients either on the basis of time spent (hourly) or, where agreed and appropriate, on a fixed fee basis.

All fees are subject to VAT at the applicable rate plus any necessary disbursements (such as Court or Tribunal fees or Expert/Counsel costs), which may also be subject to VAT.

Details of our charging structure, including hourly rates, estimates, or any agreed fixed fees, will be confirmed in our correspondence with the client at the outset of a matter and updated at appropriate stages as the matter progresses.

Guide to Service Charge Recovery Cost Information

Below is a guide as to the level of fees likely to be incurred in a standard undefended claim for unpaid service charges. These fees are not fixed and will vary from case to case.

Service Fee
Letter Before Action (LBA) for standard service charge arrears £350 plus disbursements
Disbursements will generally be incurred in obtaining official copies (£14–£28).

Fee includes/assumes:
  • sending the Letter Before Action to address stated at registry address.
  • initial contact from the defaulting Leaseholder but this is limited to making payment in full of the arrears including all and any fixed or claimed costs by electronic transfer to the correct account with the correct reference prior to the deadline stated.
  • No further action/contact required. Any further action/contact will be charged at the Hourly Rate.
Issue of Proceedings £450 – £2,500 (depending on amount of service charge arrears) plus disbursements
Disbursements will generally be incurred in obtaining official copies (£14–£28) and the Court Fee relevant to the claim (see HM Courts & Tribunals website).

Fee assumes that:
  • the address for service is one within England & Wales and postal service by the Court.
  • lease or transfer is relatively standard.
  • there is no superior title/lease requiring examination.
  • Upon service of the claim form by the Court the defaulting leaseholder makes payment in full of the arrears including all and any fixed or claimed costs by electronic transfer to the correct account with the correct reference.
  • No further action/contact required. Any further action/contact will be charged at the Hourly Rate.
Requesting / Serving Judgment £222 plus disbursements
Disbursements unlikely and will probably be limited to process server fees if recommended – generally in the region of £150–£200.
Drafting & Serving Section 146 Law of Property Act 1925 Notice £450 – £1,000 plus disbursements
Disbursements will generally be incurred in obtaining official copies (£14–£28) and where recommended, process server fees generally in the region of £150–£200.
Hourly rate (Director/Senior Solicitor) £300 per hour Hourly rates are charged by units of 1/10 of an hour (1 unit = 6 minutes).

Other Disbursements/fees

May include:

  • Counsel’s fees.
  • Experts fees.

Such disbursements/fees are subject to VAT unless advised otherwise.

  • If a service charge recovery becomes defended, we will charge on a time spent/hourly basis and any time spent on the matter will be chargeable.
